Terms of Service
These terms are the agreement between you and Allcaps ApS, a Danish company (CVR 42723576, Allegade 14, st. th., 2000 Frederiksberg, Denmark) ([email protected]), for the use of Pixify Studio, the keywording service at studio.pixify.io and beta.pixify.io. Written in plain language on purpose: the plain meaning is the one that counts.
1. What Pixify Studio is
Studio writes titles, descriptions and keywords for stock photo and video files with the help of artificial intelligence, checks them against the rules of the agencies you submit to, writes the result into your files or exports it, and learns from the corrections you make. Some features, such as team members, upload by FTP, the Lightroom plugin and the API, come with certain plans.
Studio is in beta. It works, it is used for real work every day, and it still changes often. We may add, change or remove features; if a change takes something away that you pay for, we tell you by email before it happens.
2. Your account
You need an account to use Studio. You sign in with a link we email you, so there is no password to keep, but the link is yours alone: do not forward it. One person per account. You are responsible for what happens under your account and, if you own a team, under your team.
You must be at least 16 years old. If you are under 18, a parent or guardian must agree before you buy a plan or credits.
3. Your files and your content
Your files, and the titles, descriptions and keywords Studio produces for them, are yours. You keep every right to them. You give us only what we need to do the work: to store your files, to send them to the artificial intelligence services we use for the keywording, to show the results to you and your team, and to write metadata into the copies you download. We never use your files to advertise, and we never sell or share them.
You confirm that you have the rights to the files you upload and that they break no law. We may remove files, or close an account, that are used for something illegal or for abuse of the service.
4. Credits, plans and prices
Studio counts work in credits. A plan gives a number of credits every month and unlocks features; credit packs and top-ups add credits on their own. Prices are shown in United States dollars and include Danish VAT where it applies.
- A plan's monthly credits expire at the end of the month they came with. On the Pro plan, credits you did not use carry over for one more month.
- Credits you bought as a pack or a top-up, and the free credits that come with a new account, do not expire.
- A new account gets 100 free credits once a payment card is stored with us. The card is stored, not charged: nothing is taken from it without your say-so, and it is there so that nobody can collect the free credits again and again.
- Pausing a plan freezes your credits until you come back.
- Cancelling a plan ends it at the end of the period you have paid for. Your credits stay yours until then.
5. Refunds
If you bought a plan or a pack for the first time and used less than one fifth of those credits, you can ask for a full refund within 14 days of the purchase: write to [email protected]. There is no partial refund for the rest of a month when you cancel. This does not limit the rights you have as a consumer under EU and Danish law.
6. Fair use
Studio is for keywording your own files. Do not try to get around the limits on free use, run scripts against the service beyond the API you have been given, or resell Studio's output as a service of your own. We limit how fast the service can be used, so that one person cannot slow it down for everyone.
7. What we promise, and what we do not
We work hard to keep Studio available and your data safe, and we tell you when something goes wrong. We do not promise that the service is never down or never makes a mistake. In particular, we do not promise that an agency will accept a file keyworded with Studio: the agencies decide that, and their reviewers change their minds. Always check what Studio writes before you submit.
To the extent the law allows, our liability to you is limited to the amount you paid us in the twelve months before the claim. Nothing in these terms limits a liability that cannot be limited under the law.
8. Ending the agreement
You can delete your account at any time from Settings. That ends the agreement, stops any plan at the end of its paid period, and deletes your files and your personal data the way the Privacy Policy describes. We may suspend or close an account that breaks these terms, after telling you why, unless the law requires us to act at once.
9. Changes to these terms
When we change these terms, we change the version date at the foot of this page. If a change matters to you, we email every account holder before it takes effect. Using Studio after that date means you accept the new terms.
10. Law and disputes
Danish law applies, and disputes are settled by the courts of Denmark. If you are a consumer in the EU, you keep the protection of the law of the country you live in, and you may also use the European Commission's online dispute resolution platform.
